These General Terms and Conditions of Sale, hereinafter referred to as the “Terms”, govern sales made by ChamPenja to customers placing orders through its website.

2. Scope

These Terms apply to all orders placed with ChamPenja through its website.

By placing an order, the customer confirms that they have read and accepted these Terms.

Any mandatory consumer protection provisions that apply remain unaffected.

3. Products

ChamPenja sells, among other products, Penja pepper and related food products.

The main characteristics of each product are described on the relevant product page.

ChamPenja makes every effort to present products as accurately as possible. However, slight natural variations in colour, appearance, size or presentation may occur, particularly due to the agricultural nature of certain products.

4. Prices

The prices applicable are those displayed on the website at the time the order is placed and are shown in Swiss francs (CHF).

Any applicable shipping costs are displayed separately before final confirmation of the order.

ChamPenja reserves the right to change its prices at any time. A price change will not affect an order that has already been accepted, except in the case of an obvious pricing error.

5. Minimum Age

To make a purchase from ChamPenja, the customer must be at least 18 years old or otherwise have the legal capacity required to enter into the contract.

6. Order Placement and Acceptance

After an order is submitted, the customer may automatically receive an electronic acknowledgement of receipt.

This automatic acknowledgement does not necessarily constitute final acceptance of the order.

An order is considered accepted once it has been reviewed and approved by ChamPenja and an order confirmation has been issued.

ChamPenja reserves the right to carry out any necessary checks regarding product availability and payment validity.

7. Refusal or Cancellation of an Order by ChamPenja

ChamPenja may refuse or cancel an order in particular in the event of:

• product unavailability;

• an obvious pricing, description or system error;

• failed or declined payment;

• reasonable suspicion of fraud;

• misuse or abuse of the website or services;

• clearly incorrect information provided by the customer;

• or unusually high quantities requiring prior verification.

If an order that has already been paid for is cancelled by ChamPenja and no goods have been supplied, the relevant amount will be refunded in accordance with the applicable arrangements.

8. Payment

The customer is responsible for ensuring that all information provided during payment is accurate.

Orders may be subject to authorisation by the payment service provider used.

If payment is declined or unsuccessful, ChamPenja may suspend or cancel the order.

9. Availability

Products are offered subject to stock availability.

If a product becomes unavailable after an order has been placed, ChamPenja may contact the customer to offer an appropriate solution or cancel and refund the affected product.

10. Order Quantities

There is currently no minimum order quantity for standard purchases.

There is also no fixed maximum quantity.

However, ChamPenja reserves the right to review, limit or refuse orders involving unusually large quantities.

Large professional or B2B orders may be subject to a separate quotation, offer or specific commercial terms.

11. Special and Custom Orders

ChamPenja does not currently offer subscriptions or digital products.

Specific terms may be agreed for certain customised or special orders, including:

• corporate gifts;

• professional orders;

• customised orders;

• or high-volume purchases.

Where specific terms have been agreed for an order, those terms supplement these Terms and may take precedence in relation to the matters expressly covered by them.

12. Delivery

ChamPenja currently delivers to Switzerland and Liechtenstein.

Orders are generally prepared within 1 to 3 business days after payment has been received.

Delivery generally takes approximately 2 to 4 business days after dispatch.

Orders are shipped via Swiss Post.

Shipping costs are CHF 6.90 per order.

Shipping is free for orders of CHF 80 or more.

For further information, customers should refer to the Shipping and Delivery Policy available on the website.

13. Returns and Refunds

Due to the nature of the food products sold, opened or used products are generally not eligible for return, subject to any mandatory consumer rights that may apply.

An unopened and unused product kept intact in its original packaging may be accepted for return on a case-by-case basis after prior approval from ChamPenja.

14. Damaged, Defective or Incorrect Products

Customers are encouraged to inspect their order upon receipt.

If a product is damaged, defective or incorrect, the customer should contact ChamPenja as soon as possible and provide the order number together with, where possible, photographs showing the issue.

ChamPenja will review the request and may offer, depending on the circumstances, a replacement or refund.

Any mandatory legal rights relating to defects or non-conformity remain unaffected.

15. Cancellation by the Customer

The customer may request cancellation of an order as long as it has not yet been prepared or shipped.

Once order preparation or dispatch has begun, cancellation can no longer be guaranteed.

16. Liability

ChamPenja makes reasonable efforts to ensure the accuracy of the information published on its website and the normal availability of its services.

ChamPenja cannot, however, be held responsible for delays or failures caused by circumstances beyond its reasonable control, including transport interruptions, major technical incidents, natural disasters, strikes or similar events.

Nothing in these Terms is intended to exclude or limit liability where such liability cannot legally be excluded or limited.

17. Intellectual Property

Unless otherwise stated, all text, photographs, illustrations, logos, graphic elements, trademarks and other content displayed on the ChamPenja website are protected by applicable intellectual property laws.

Any reproduction, use, modification or distribution without prior authorisation is prohibited, except where permitted by law.

18. Data Protection

Personal data collected in connection with orders and use of the website is processed in accordance with ChamPenja’s Privacy Policy and applicable data protection laws.

19. Changes to These Terms

ChamPenja may amend these Terms to reflect changes in legal, commercial or technical requirements.

The version applicable to an order is generally the version in force at the time the order is placed.

20. Governing Law and Disputes

These Terms are governed by Swiss law, subject to any mandatory consumer protection provisions that may apply to the customer and which cannot legally be excluded by agreement.

Any dispute will be submitted to the competent courts in accordance with applicable legal rules.

Where the law grants a consumer a mandatory place of jurisdiction or another right of redress, that right remains unaffected.
